Lending money secured by Deeds of Trust on local real estate
is an investment to consider. Trust deed investments can be
made by individuals as well as IRA accounts, 401k's, pension
plans and Corporations.
Here's how it works: A borrower who owns real estate,
(it could be a house, income property, land, commercial or
mixed use property located in the San Francisco Bay Area)
is referred to E. F. Foley & Co., Inc. and a loan request
is made.
We receive an application, credit report, income documentation and appraisal. We then analyze the borrower's ability to make the payments, and if the property's value checks out, we arrange a loan of 50% to 65% of the property's value. For instance if the property is valued at $500,000, we might lend up to $325,000 (or 65% of the property's value).
These loans have terms of 2-5 years with the total principal paid back at the end of the loan. You, as the investor, are paid an interest rate of 8-10%* plus any late fees that may accrue. Here's the secured part: your name is listed on the deed of trust as a beneficiary (or lender), which is recorded against the property. The borrower must make the payment, or you have the ability to foreclose to recoup your investment. For additional protection, the transaction is completed by an independent escrow company and title insurance is obtained to protect your ownership position in the property. The loan servicing is handled by E. F. Foley & Co., Inc. We track and collect the monthly payments and disburse your portion to you by check or direct deposit.
Pam Foley, broker/owner, reviews each potential loan herself to ensure that it is the right fit for both the investor and borrower. If the loan looks to be a good fit, we send each potential investor a 6 page lender disclosure and other information detailing the borrower, property and loan terms.

Lenders are encouraged to drive by the potential investment property to help them make an informed investing decision. After the close of escrow you will receive a copy of the promissory note and recorded deed of trust showing your percentage interest along with any other investors of the property.
